Terms of Service
Last updated 15 October 2026
These terms are an agreement between you and AI Brain (“AI Brain”, “we”, “us”), the service at brainformyai.com. By creating an account or using AI Brain, you agree to them and to our Privacy Policy. If you don't agree, don't use AI Brain.
Please read section 15 carefully. It says disputes between us are settled by individual arbitration rather than in court, and that you give up the right to bring or join a class action.
1. Who can use AI Brain
You must be at least 18 and able to enter a binding contract. If you use AI Brain for an organisation, you confirm you may accept these terms for it, and “you” includes that organisation.
2. Your account
Give accurate information, keep your password private, and tell us straight away if you think someone else has used your account. You are responsible for everything done with your account, including by AI tools you connect to it. One person per account.
3. What you put in is yours
You keep ownership of the files, instructions and other material you put into AI Brain (“your content”). You give us permission to store, copy, process and display your content only as needed to run AI Brain for you: to show it to you and the people you share it with, to give it to the AI tools you connect, to back it up, and to keep the service secure. This permission ends when your content is deleted, apart from copies in backups, which expire as our Privacy Policy describes. We don't use your content to train AI models.
You confirm that you have the right to put your content here and to share it as you do, and that doing so doesn't break any law or anyone else's rights.
4. What doesn't belong in AI Brain
AI Brain is built for knowledge, notes, skills and working documents. It is not designed or certified for regulated or highly sensitive information, and you agree not to store or share any of the following here:
- Health information covered by health privacy laws, such as protected health information under HIPAA. We are not a “business associate” and will not sign a business associate agreement.
- Payment card data, such as full card numbers or security codes, and bank account credentials.
- Government identifiers, such as Social Security numbers, passport or driver's licence numbers.
- Passwords, API keys and other secrets that give access to other accounts or systems.
- Other regulated or special-category data, such as data subject to export controls, or information about children, where the law requires protections AI Brain doesn't offer.
If you store any of this anyway, you do so at your own risk, and you are responsible for meeting any legal duties that come with it.
5. Acceptable use
You agree not to use AI Brain to:
- break the law, or help anyone else do so;
- store or share content that is illegal, sexually exploits children, harasses or threatens anyone, or infringes someone else's intellectual property or privacy;
- upload malware, or pages or files meant to deceive, harm or take over other people's accounts or devices;
- get into accounts, files or systems you aren't allowed into, or test, probe or get around our security without our written permission;
- overload, disrupt or reverse-engineer the service, or reach it by automated means other than the AI connections we provide;
- resell or rent out AI Brain, or use it to build a competing service;
- send spam or unwanted messages through sharing or invitations.
6. Connecting an AI
You decide which AI tools to connect and what each file allows an AI to do. When you connect one:
- Content your AI reads goes to that AI's provider, under its own terms and privacy policy, which we don't control. Connect only providers you trust with that content.
- You are responsible for what your AI does in AI Brain on your behalf, including anything it writes, changes or deletes where you've allowed it to.
- AI can be wrong. Anything an AI produces, including pages and files it writes here, may be inaccurate or incomplete. Check it before relying on it, especially for anything medical, legal, financial or safety-related. AI Brain doesn't give professional advice.
7. Sharing
When you share a file, folder or brain, the people you share it with can see it, and, if you let them, change it and pass it to their own AI. You are responsible for who you share with and for removing access when it should end. People who share with you remain responsible for their content.
8. Plans, limits and payment
AI Brain has a free plan and paid plans with more room. Each plan's limits are shown in the app. If you go over your plan's limits, for example after moving to a smaller plan, nothing is deleted, but you can't add more, your AI can use only what your plan covers, and anything outside it becomes view only until you upgrade or make room.
When paid plans open: they renew automatically each month or year until you cancel; you can cancel at any time, and your plan continues until the end of the period you have paid for; payments aren't refundable except where the law requires; and we may change prices with at least 30 days' notice, starting from your next renewal. Taxes may be added where they apply.
9. Keep your own copies
We work hard to keep your content safe, including restore points and backups, but no system is perfect and we can't promise that nothing will ever be lost, damaged or seen by someone it shouldn't be. Keep your own copies of anything important to you.
10. Changes to the service
AI Brain is new and still changing. We may add, change or remove features, and the service may sometimes be unavailable, including for maintenance. If we decide to shut AI Brain down, we will give you at least 30 days' notice and a way to download your content.
11. Ending your use
You can stop using AI Brain at any time, and ask us to delete your account by writing to hello@brainformyai.com. We may suspend or close your account if you break these terms, if the law requires it, or if your use puts other people or the service at risk. Where we reasonably can, we will tell you first and give you a chance to download your content. Sections 3 (the permission for backups to expire), 9, and 12 to 17 continue after your account ends.
12. No warranties
AI Brain is provided “as is” and “as available”. To the fullest extent the law allows, we make no promises of any kind, express or implied, including that it will be uninterrupted, secure, error-free, or fit for a particular purpose, or that content will never be lost, or that anything produced by an AI is accurate.
13. Limits on our liability
To the fullest extent the law allows, AI Brain will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or relating to AI Brain or these terms, even if we were told they were possible. Our total liability for any claim arising from or relating to AI Brain or these terms is limited to the greater of the amount you paid us in the 12 months before the claim, or 50 US dollars.
Some places don't allow these limits, so some of them may not apply to you. Nothing in these terms limits liability that the law doesn't allow to be limited.
14. Your responsibility to us
If someone makes a claim against us because of your content, your use of AI Brain, or what your connected AI did on your behalf in breach of these terms, you agree to cover our reasonable costs and losses from that claim, including reasonable legal fees, to the extent the law allows.
15. Settling disputes: arbitration and no class actions
If you have a problem, write to hello@brainformyai.com first; most things can be fixed that way. If we can't settle a dispute within 60 days, then:
- Arbitration. Any dispute arising from or relating to AI Brain or these terms will be settled by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, not in court. The arbitration may be held by phone, video or written submissions, or in your home county.
- No class actions. You and we may bring claims only individually, not as a plaintiff or class member in any class, group or representative action, and the arbitrator may not combine claims of different people.
- Exceptions. Either of us may bring an individual claim in small claims court, and either of us may ask a court to stop infringement or misuse of intellectual property.
- Opting out. You can opt out of this section within 30 days of first agreeing to these terms by emailing hello@brainformyai.com with your account's email address and a statement that you opt out of arbitration.
If the class action waiver is found unenforceable for a claim, that claim will go to the courts named in section 16 instead, and not to arbitration.
16. Governing law
These terms are governed by the laws of the State of Idaho and the United States, without regard to conflict-of-law rules. Any dispute not sent to arbitration will be heard only in the state or federal courts located in Idaho, and you and we agree to their jurisdiction. If you live in a country whose laws give you rights that can't be waived by agreement, these terms don't take them away.
17. Everything else
- Copyright complaints. If you believe something in AI Brain infringes your copyright, write to hello@brainformyai.com with the details the US Digital Millennium Copyright Act asks for, and we will respond.
- Changes to these terms. We may update these terms. If a change is significant, we will tell you by email or in the app before it takes effect, and ask you to agree again. Using AI Brain after a change takes effect means you accept it.
- Whole agreement. These terms and the Privacy Policy are the whole agreement between us about AI Brain. If any part is found unenforceable, the rest still applies. Not enforcing a part right away doesn't mean we give it up.
- Transfer. You may not transfer these terms without our permission. We may transfer them, for example to a company formed to run AI Brain or as part of a sale or reorganisation, and will tell you if we do.
- Things outside our control. We aren't responsible for failures caused by events beyond our reasonable control, such as outages at our providers, natural disasters or attacks.
